Won the cross-border payment arbitration case: Chinese overseas companies fully recovered frozen capital, and the case handling period was 40% shorter than the industry

Recently, a typical case of cross-border payment arbitration in Southeast Asia that was concluded in early 2026 has attracted widespread attention from overseas companies.
The China-Singapore dual-jurisdiction foreign-related commercial dispute resolution team jointly handled the case, leading the Singapore International Arbitration Center arbitration proceedings throughout the entire process, recovering the disputed amount in full for the entrusted Chinese technology company, successfully removing it from the global high-risk merchant list, achieving zero loss of commercial reputation, and shortening the case processing cycle by 40% compared with the industry average. Its case handling model of “dual-jurisdiction evidence certification + local arbitration process leadership + regulatory compliance pressure” has been widely used in the resolution of cross-border payment disputes in Southeast Asia.

It is understood that the client of this case is a leading domestic technology company. Its Singapore branch, as the main operating entity in Southeast Asia, signed an exclusive payment service agreement with a global top 3 online payment service provider, entrusting it to handle online transaction collection and payment business in six countries including Singapore, Malaysia, and Indonesia. The average daily transaction turnover exceeds 200,000 US dollars.
In May 2025, without fulfilling its obligation to notify in advance and without providing any evidence of violations, the service provider unilaterally froze all account funds of the client’s Singapore branch and included it in the list of global high-risk merchants. This resulted in the interruption of all online transactions in the client’s Southeast Asia region. The salary payment of nearly 300 local employees was blocked, and direct economic losses exceeded one million yuan.
The client communicated with the service provider’s Asia-Pacific headquarters 11 times through emails, video conferences, etc., but was refused to unfreeze the account and remove the list on the grounds of “internal risk control rules”, and then entrusted the China-Singapore joint team to intervene in rights protection.

Dual-jurisdiction case handling team remotely discusses the case site

The case adopts a standardized collaboration model in which “the Chinese team is responsible for the construction of evidence in the Chinese jurisdiction and coordination with the client, and the local team in Singapore is responsible for promoting local judicial procedures and connecting regulatory resources”: Within 5 days after receiving the case, legal personnel from both sides completed the risk assessment of the dual-jurisdiction case simultaneously, and the Chinese team sorted out the company’s equity structure and capital transaction records
Issue a compliance assessment report to confirm that the client’s transaction behavior is completely legal; the Singapore team verified the validity of the payment service agreement under Singapore law, retrieved 12 regulatory penalty cases from the Monetary Authority of Singapore on the abuse of risk control rights by payment service providers in the past three years, assessed the probability of winning the arbitration, and verified the respondent’s property clues in Singapore through the Singapore Commercial Registration Authority and local bank channels to prepare for subsequent execution.
Within more than a month, the two parties completed the Chinese notarization + Singapore local dual certification of all electronic evidence. The Chinese team conducted hash value verification and blockchain timestamp solidification of all electronic data such as transaction flows, communication records, and risk control notices since 2023 in accordance with domestic electronic evidence fixation rules.
The notary agency issues an electronic evidence notarization certificate; the Singaporean team completes the local validity confirmation of the notarial certificate in accordance with the local Electronic Transactions Act. At the same time, it applies to the Monetary Authority of Singapore for information disclosure, and obtains the respondent’s complaint records of similar risk control measures in the same period to strengthen the evidence chain of its abuse of risk control discretion.
In July 2025, an application for filing a case was formally submitted to the Singapore International Arbitration Center, clearly stating four demands: full refund, removal from the high-risk list, compensation for interest on occupied funds, and bearing of all arbitration fees. After multiple rounds of written confrontations, arbitral tribunal procedural meetings and dual-track pressure negotiations of “arbitration procedures + regulatory complaints”, the two parties formally reached a settlement in January 2026. The service provider fulfilled all obligations within the agreed time limit, and the case was successfully settled.

Display of Arbitration and Compliance Materials Related to the Case

As a typical dispute case in the cross-border payment field in Southeast Asia, the case involved difficulties such as the boundary of the payment service provider’s unilateral risk control rights, the enforceability of high-risk list removal, the admission of cross-border electronic evidence, and the promotion of efficient reconciliation, all of which are common issues faced by Chinese overseas companies.
In response to this type of risk, professionals also gave three practical suggestions: First, standardize the payment service agreement. When signing the agreement, clearly agree on high-risk transaction identification standards, risk control implementation procedures, and dispute resolution methods. Give priority to the Singapore International Arbitration Center as the dispute resolution institution. Delete the unfair content in the format clauses that unilaterally exempts the service provider from liability and increase the merchant’s obligations. Second, standardize electronic evidence and fix transaction flow, communication records, risk control notices, and billing vouchers.
Electronic data must be regularly backed up and notarized. It is recommended that blockchain timestamps be solidified every six months to ensure the legal validity of evidence in cross-border disputes. The third is rights protection and risk control early warning. Establish a cross-border payment business risk control early warning mechanism. When the service provider raises abnormal risk control requirements, professionals will be entrusted to intervene immediately. If an account is frozen or included in a high-risk list, arbitration procedures must be initiated within one month to avoid irreversible operating losses caused by long-term occupation of funds.
